Now, last Friday, Mitch and I went to Bakersfield and we located the court where this hearing is going to be held, the probate department. We went to the probate department itself, we pulled out the file, and we found out that no opposition had been filed to our pleadings. And we ascertained from the clerks, which I pretty much knew, that this was a real good fact for us. After that, we went to the probate department itself. We were able to make contact with the probate clerk for the commissioner. We found out that the commissioner was a woman, Commissioner Ryan. And we talked extensively with her clerk for the exact procedures in that particular courtroom. We found out from her that there are pretty much identical procedures being held Monday morning. That's tomorrow morning. And I have to be in Mojave tomorrow morning, and some of us, other persons have to be in Mojave. And Mitch has very kindly agreed to bypass the Mojave appearance and Mitch is going to be our person on site in the Bakersfield Probate Court at 8.30 tomorrow morning and spend the better part of three or four hours there and just to observe, watch, evaluate the Commissioner and how those probate matters are held. I personally have been involved in over 3,000 cases, but I've never tried a probate case. In fact, I'm not sure I've ever been in a probate hearing. So we're doing some extra preparation for this case. Mitch will be back here in time for the 1 o'clock meeting. And at that time, we hope and know Mitch. analysis of Commissioner Ryan, the court, and how it was conducted. Well, Friday after we had talked with the clerk, the legal research person at the courthouse, he and I met with Mr. Gardner, who is a public defender officer assigned to the probate department and who was a weak cause to be appointed to represent John. And we ascertain from him that he will be present, but he is not taking a position on the case and that's very good for us. And at some point Judge Ryan or Commissioner Ryan may turn to him and say, do you have a position one way or the other, and his answer will be no and that's a plus for us. Now we have received some notice that John's sister has sent a declaration to the court which will probably be late but we should be prepared for it and I am prepared for it and I'll disclose that defense to everybody tomorrow about one o'clock. So we are well prepared for the hearing Tuesday morning at 8.30. We're going to have a crack crew ready. And I think it would be nice if a lot of you persons did come there. I wasn't able to see the size of the courtroom, but I think it's quite a large courtroom. And I should tell you we are on a winning streak and we want to continue to be on that winning streak. So the court gave him until Monday morning to bring himself up to date with all the pleadings. I did pick up a copy of his response on the 19th. They were absolutely terrible. We don't expect any problem tomorrow morning. The only problem might be the reluctance of the court to make a decision as opposed to continue the matter to see what's going to happen in the civil aspect of it in Bakersfield. As a non-biased reporter, I have to say, Judge Wallace was particularly articulate and brilliant in his gentle slamming of Horne's approach to delude and deceive the court.
